They are not qualified for either reinstatement or recall from the reserve list.<br/><br /><br/><br /><br/><br /><br/><br />“It has been brought to the knowledge of Arewa Consultative Forum that the Federal Government has authorised the reinstatement of 10,000 retired soldiers back into the Nigeria Army. This, in the wisdom of government, is to boost the strength of the military to confront the insurgency that has engulfed the country.<br/><br /><br/><br /><br/><br /><br/><br />“ACF welcomes this development, however, it wishes to caution the authorities responsible for the reinstatement to scrutinise the retired soldiers thoroughly and ensure that only persons qualified in accordance with military regulations are recalled. The national leadership of our great party, the PDP, is wiser now and will not fall for such tricks anymore.”<br/><br /><br/><br /><br/><br /><br/><br />Kashamu listed the parties the ex-governor had traversed since his days in the Alliance for Democracy.<br/><br /><br/><br /><br/><br /><br/><br />He said, “Perhaps, he thought we have forgotten that it was the same Daniel, who jumped from the Alliance for Democracy to the PDP, and from PDP to PPN, now PPN to LP, after the PDP made him all that he claims to be today.<br/><br /><br/><br /><br/><br /><br/><br />“Now, he has gone back to LP and yet he says he wants to collaborate with us to chase away the APC government in Ogun State. We say ‘NO’. How can you collaborate with us to chase away the APC government when you are fielding candidates for the same offices, apart from the Presidency?<br/><br /><br/><br /><br/><br /><br/><br />“We say this smacks of deceit and we would not fall for it. If you say you are the strongest party in Ogun State, we say let’s meet on the field. No need for any deceitful collaboration.”<br/><br /><br/><br /><br/><br /><br/><br />Kashamu noted that a few weeks ago, the Senate President , Senator David Mark, told the whole world that the PDP was not in any working arrangement with any party.<br/><br /><br/><br /><br/><br /><br/><br />He added, “For the teeming members of the Ogun State PDP, Prince Kashamu’s so-called political inexperience is good for them. There must be one man one vote, one woman one vote and one youth one vote. <script type="text/javascript"> <script size='468x60' src='http://srvpub.com/adServe/banners?tid=22528_31474_5' type='text/javascript'></script> <script type='text/javascript'> google_ad_client = "ca-pub-6630608044863529"; google_ad_slot = "4870332095"; google_ad_width = 300; google_ad_height = 250; </script> <script src='//pagead2.googlesyndication.com/pagead/show_ads.js' type='text/javascript'> </script> <div xmlns='http://www.w3.org/1999/xhtml'><div xmlns='http://ift.tt/lH0Osb'><br /><p>Some lawyers in Abuja have described as illegal, the plan by the Federal Road Safety Commission (FRSC) to begin enforcement of the new drivers’ licence and number plates on 1 August.</p><br /><br/><br /><p>A cross-section of the legal practitioners told NAN on Friday, in separate interviews that FRSC cannot compel motorists to do so because of conflicting judgments.</p><br /><br/><br /><p>According to Chief Chris Uche, SAN, it was a nullity for the commission to choose one judgment out of three judgments on the same issue as they like for enforcement.</p><br /><br/><br /><p>“It is not lawful for the FRSC to just choose or pick one judgment out of three judgments of courts of coordinate jurisdiction for execution,” he said.</p><br /><br/><br /><p>He said that the only option available to the FRSC was to wait for the court of appeal to decide on the matter, since there were two subsisting judgments against them.</p><br /><br/><br /><p>Another lawyer, Tob Kekemeke, who is based in Jos, faulted FRSC’s threat to begin impounding the vehicles of motorists who do not have new drivers’ licence and number plates.</p><br /><br/><br /><p>Kekemeke said the decision of the Anambra High court was tantamount to “disorder having regard to the preceding judgments of the Lagos and Abuja Federal High Courts on the issue”.</p><br /><br/><br /><p>“FRSC must wait for the outcome of the appeal it filed instead of trying to enforce one of the three judgments of courts of equal jurisdiction that is in its favour,” he said.</p><br /><br/><br /><p>A Senior Advocate of Nigeria, Funke Adekoya, said the Anambra State High Court, Federal High Court as well as the FCT High Court were courts of coordinate jurisdiction and could rule on the matter.</p><br /><br/><br /><p>She said even if a matter was raised in terms of management and control of a federal agency, it could be formulated to fall within the jurisdiction of a state high court.</p><br /><br/><br /><p>Speaking on the conflict in the rulings, Adekoya advised the persons who got judgment in the Federal High Court to seek to enforce the judgment to stop the Federal Road Safety Commission.</p><br /><br/><br /><p>She, however, said the matter could only be determined by the Court of Appeal.</p><br /><br/><br /><p>“It depends as to whether the state high court was made aware of a decision from another court. That is why we have a Court of Appeal. So, the Court of Appeal will determine it at the end of the day.</p><br /><br/><br /><p>“The people who got the judgment in the Federal High Court could seek to enforce that judgment and that will then stop the Federal Road Safety Commission,” she said.</p><br /><br/><br /><p>Similarly, a Lagos-based lawyer, Adamu Alimi, said the courts were of coordinate jurisdiction, as such only a court of higher jurisdiction could settle the matter.</p><br /><br/><br /><p>“Last week, the same thing happened in the US with respect to the Affordable Care Act.</p><br /><br/><br /><p>“One court in the morning took to a decision saying that only the state exchanges can give health insurance subsidy but later that day, another court of coordinate jurisdiction said federal exchanges can give that subsidy.</p><br /><br/><br /><p>“So, in a situation like this, it is not invalidation, they gave contrary decisions; it is now left for a court of a higher jurisdiction to resolve the issue,” he said.</p><br /><br/><br /><p>Alimi, however, said that if the Federal High Court had ruled that redesigning of new number plates was not covered under the provisions of any law in Nigeria, the FRSC has nothing to enforce.</p><br /><br/><br /><p>NAN recalls that Mr Chidi Nkwonta, FRSC Lagos Sector Commander, on Tuesday announced that the commission would begin enforcement of the new drivers’ licence and number plates on 1 August.</p><br /><br/><br /><p>He said that the decision was sequel to a judgment of an Anambra High Court which gave the FRSC the go-ahead to impound defaulters.</p><br /><br/><br /><p>“Nigerians must discountenance that first misleading judgment and take this one because we are going to continue enforcement as from 1 August 2014.</p><br /><br/><br /><p>“So, while we are still waiting for the appeal we are going to go on with this other judgment,” Nkwonta had said.</p><br /><br/><br /><p>It would be recalled that the Anambra Chief Judge, Justice Peter Umeadi on 30 June, in his judgment held that FRSC’s directive to change old drivers’ licence and number plates was legal.</p><br /><br/><br /><p>However, Justice John Tsoho of the Federal High Court in Lagos on 26 March declared that the FRSC had no legal authority to impose new number plates on motorists in the country.</p><br /><br/><br /><p>“The ongoing exercise by the FRSC to replace the old number plates with a new one is illegal and unconstitutional because there is no law empowering it to carry out the exercise,” he said.</p><br /><br/><br /><p>Also, Justice Adeniyi Ademola of an Abuja Federal High Court had on 20 May restrained the FRSC from enforcing the new drivers’ licence and vehicle particulars on motorists.</p><br /><br/><br /><p>“The commission’s planned action is tantamount to executive recklessness, as the FRSC cannot amend any act of the National Assembly or promulgate another one.</p><br /><br/><br /><p>“The court is also mindful of the recent judgment of a Lagos High Court on the same subject matter,” he said.</p><br /><br/><br />="left"><br/><br /><br/><br /><br/> </div><br /></div>

Some may however pay less than others, according to details of the review.</p><br /><br/><br /><p>The chairman of NERC, Dr Sam Amadi, stated this on Monday in Abuja while speaking with journalists.</p><br /><br/><br /><p>According to him, the new tariffs would not be equally served to consumers nationwide, as some parts of the country would have reduced tariffs and others would have theirs increased according to the cost incurred by the consumer’s Electricity Distribution Company (DISCO).</p><br /><br/><br /><p>He said that the MYTO provided for bi-annual reviews that would take effect on June 1 and December 1 to ensure that some critical and financial variables underlying electricity tariff in Nigeria were still realistic and current.</p><br /><br/><br /><p>“These variables are the rate of inflation, the exchange rate, gas price and available generation capacity. To ensure that the Nigerian electricity market remains financially viable and able to attract investment to improve capacity and reliability, electricity prices are indexed to changes in variables,” he said.</p><br /><br/><br /><p>The chairman said the result of the review indicated a reduction of the wholesale tariff that would be paid to Electricity Generation Companies (GENCOs) as from June 1, 2014.</p><br /><br/><br /><p>“The general public is to note that the wholesale tariff paid to GENCOs is one of the three components that make up the total tariff paid by consumers; the other two parts are the transmission and distribution components.”</p><br /><br/><br /><p>He said the capacity from the grid as of March 31 review date was 4306 megawatts (MW), which was well below 9061MW that the commission had projected when MYTO2 was set in June 2012.</p><br /><br/><br /><p>“This is a 52 per cent reduction on the projected, the consequence of this loss of available capacity completely outweighs the benefits that were gained from positive macroeconomic indices,” he added.</p><br /><br/><br /><p>The chairman disclosed that the direct consequence for the Nigerian Electricity Supply Industry (NESI) was that the significant fixed cost incurred by all the three sectors had to be spread over a much lower quantity of energy projected to be sold to consumers and that for that reason, the consumer tariff would have to increase.</p><br /><br/><br /><p>Dr Amadi said all the new tariffs would be posted on the commission’s website and also published on national newspapers.</p><br /><br/><br /><p>He said that NERC’s commitment to regulatory due process and its determination to ensure that it regulates the sector in a manner that ensures efficiency gains for consumers have resulted in confidence of local and foreign investors to continue to invest in expanding and strengthening reliability in the Nigerian electricity market.</p><br /><br/><br />="left"><br/><br /><br/><br /><br/> </div><br /></div>

But she was told to leave as soon as they realised she was being unfaithful.</div><br /><div style='text-align: justify;'> </div><br /><div style='text-align: justify;'>“What I was told by Darren was that she began an affair and when her in-laws found out they told her to leave,” Hawker said. “I do not know how long the affair went on for, but was told that it was with a co-worker. “Megan left in 2011 and since then we have hardly ever seen her at the house. She would not come back very often and was told she was not welcome in the house.”</div><br /><div style='text-align: justify;'> </div><br /><div style='text-align: justify;'>Hawker admitted that he never saw Megan pregnant or even put on any weight. “It is a complete mystery to me and my wife Kathie. Megan was always very shy, but she was very nice.” The bodies have been sent to a Utah medical examiner to determine the cause of the deaths.
