Gen. Mohammadu Buhari (rtrd.), was filed before a Federal High Court, Abuja, on Wednesday.<br/><br /><br/><br /><br/><br /><br/><br />It made the third suit that has been filed to seek an order declaring Buhari ineligible to contest the February 14 election.<br/><br /><br/><br /><a id="more" name="more"> </a><br/><br /><br/><br /><br/><br /><br/><br />Apart from the disqualification suit, there is a pending direct criminal complaint against Buhari before a Federal Capital Territory Magistrate’s Court in Abuja asking the court to direct that the former Head of State “be brought to book” for allegedly claiming on oath that he had a certificate he did not obtain.<br/><br /><br/><br /><br/><br /><br/><br />Justice Adeniyi Ademola of the Federal High Court in Abuja has already fixed February 9 for hearing in the two previous suits.<br/><br /><br/><br /><br/><br /><br/><br />The judge had separately on Monday and Tuesday ordered service of court papers through substituted means through publication newspapers in the two suits.<br/><br /><br/><br /><br/><br /><br/><br />The fresh suit, which is the third seeking Buhari’s disqualification was filed by Dr. Ayakeme Whiskey on Tuesday.<br/><br /><br/><br /><br/><br /><br/><br />The INEC and Buhari are the two defendants in suit marked FHC/ABJ/CS68/2015.<br/><br /><br/><br /><br/><br /><br/><br />Like the plaintiffs in the two previous suits, Whiskey anchored his on the same grounds of alleged failure of Buhari to accompany his Form CF001 submitted to the Independent National Electoral Commission, with his certificates of academic qualifications.<br/><br /><br/><br /><br/><br /><br/><br />He argued that failure of Buhari to do so had rendered him ineligible to participate in the poll as he failed to comply with provisions of sections 131 and 318 of the 1999 Constitution and section 31(3) of the Electoral Act, 2010.<br/><br /><br/><br />His supporting affidavit read in part, “That the documents submitted 2nd defendant did not show evidence of school certificate, whether first or secondary.<br/><br /><br/><br /><br/><br /><br/><br />“That by not providing and attaching his certificates as required, the 2nd defendant has left the question of his qualification for the election to conjecture.<br/><br /><br/><br /><br/><br /><br/><br />“There is no way to know whether or not the 2nd defendant has the requisite educational qualification necessary to contest the position of President of the Federal Republic of Nigeria.”<br/><br /><br/><br /><br/><br /><br/><br />One of the two earlier suits numbered FHC/ABJ/CS/14/2015 was filed by Max Ozoaka. If you move from your bedroom to your sitting room, you ‎have made a change. But you have not transformed yourself. If you move from your sitting room to your kitchen, you have changed. But you have not transformed ‎yourself.<br/><br /><br/><br /><br/><br /><br/><br />“We will move this country forward. Singapore and Nigeria used to be on the same level. But someone transformed Singapore from third-world to first-world. That is the transformation we are talking about. We do not think anybody, not to talk of somebody who is a Christian, can make such statement.<br/><br /><br/><br /><br/><br /><br/><br />“We challenge the Director General of APC to name such pastors and where the money is coming from.<br/><br /><br/><br /><br/><br /><br/><br />‎”This attack is capable of bringing Christians and Muslims into a major disagreement and major dispute. If truly the person who issued this statement is a Catholic as he said, we are asking him to go for confession.”<br/><br /><br/><br /><br/><br /><br/><br />Metuh also accused the Independent National Electoral Commission of conniving with the APC to deny non-indigenes ‎in Lagos State permanent voter cards.<br/><br /><br/><br /><br/><br /><br/><br />According to him, the PVCs belonging to PDP supporters were being burnt in some states, and that the party had reported the matter to the electoral body.<br/><br /><br/><br /><br/><br /><br/><br />Metuh said, “This has never happened before but we don’t know why the APC are doing such; maybe because we have credible presidential candidate.<br/><br /><br/><br /><br/><br /><br/><br />“We have the records and we are asking the non-indigines involved that if by Friday, INEC still do not give them their PVCs, we will take decisive action.<br/><br /><br/><br /><br/><br /><br/><br />“We know that 90 percent of these non-indigenes are supporters of PDP. Those warnings, it said, were ignored by the Nigerian Security agencies, leading to the unfortunate and regrettable casualties.<br/><br /><br/><br /><br/><br /><br/><br />“If as Goodluck Jonathan claimed, that he was a target of an “assassination” attempt, why did we issue a prior warning?” it questioned. Where in this world would an assassin warn their target in advance of an attempt on their life? This false allegation by Goodluck Jonathan, further confirms our earlier assertion of how he takes Nigerians for stupid as he seem to have forgotten how he openly came out to absolve MEND of any involvement in the attack. Rather than address his administration’s failures, he chose to descend so low by using a very cheap bare faced lie to get sympathy.
