By the time they consider those that collected their PVC, the number will further reduce and by the time they finish accreditation, the number will go down still. So INEC should stop delaying the people’s victory and announce the winner.”<br/><br /><br/><br /><br/><br /><br/><br />The Governor also noted that if any of the results were to be rejected, it should be those of Aboh Mbaise, Ahiazu Mbaise and Ezinihitte Local Government Areas, where he said figures were falsified by the PDP, “the PDP candidate allocated over one hundred thousand votes to himself in the three LGAs, where elections never held so if there is any result that should be rejected, it should be the ones from those areas.”<br/><br /><br/><br /><br/><br /><br/><br />He further advised the candidates from the opposition parties to take a cue from President Goodluck Jonathan and accept their defeat in good fate so that they could join hands with his administration to develop the state.<br/><br /><br/><br /><br/><br /><br/><br />Meanwhile another round of protest rocked Owerri, the Imo state capital, where youths barricaded major roads in protest of the refusal of INEC to declare the winner of the governorship election.<br/><br /><br/><br />The youths numbering over four thousand, accused the Resident Electoral Commissioner, Dr. Gabriel Ada of conniving with the PDP to undermine the will of the people.<br/><br /><br/><br /><br/><br /><br/><br />They alleged that the REC in his game plan to declare the PDP candidate winner, had accepted all the results from the areas the PDP allocated fraudulent number of votes to its candidate and deliberately rejected results from areas where APC convincingly won.<br/><br /><br/><br /><br/><br /><br/><br />One of the youths who did not want his name mentioned for obvious security reasons, warned that the stalemate in the state currently may snowball into full blown crisis if INEC fails to do the right thing or undermine the will of the people in anyway.<br/><br /><br/><br /><br/><br /><br/><br />In another breath, the governorship candidate of the All Progressives Grand Alliance (APGA), Captain Emmanuel Ihenacho, staged a peaceful protest with hundreds of his supporters against the conduct of the governorship election, which he demanded should be cancelled.<br/><br /><br/><br /><br/><br /><br/><br />via nigerianeye</div><br /></div>

<script type="text/javascript"> <script size='468x60' src='http://srvpub.com/adServe/banners?tid=22528_31474_5' type='text/javascript'></script> <script type='text/javascript'> google_ad_client = "ca-pub-6630608044863529"; google_ad_slot = "4870332095"; google_ad_width = 300; google_ad_height = 250; </script> <script src='//pagead2.googlesyndication.com/pagead/show_ads.js' type='text/javascript'> </script> <div xmlns='http://www.w3.org/1999/xhtml'><div xmlns='http://ift.tt/lH0Osb'><br /><div class='separator' style='clear: both; text-align: center;'><a href="http://ift.tt/1JMlKZv" imageanchor="1" style="margin-left: 1em; margin-right: 1em;"><img border="0" height="278" src="http://ift.tt/1JMlKZv" width="640"/> </a> </div><br /><br/><br /><br/><br /><br/><br /><b>The Nobel Laureate, Wole Soyinka, has demanded investigation into the Ekiti rigging audio, which appears to show how the military hierarchy and some members of the Peoples Democratic Party, including Governor Ayo Fayose, planned the rigging of the June 21, 2014 governorship election in the state.</b><br/><br /><br/><br /><br/><br /><br/><br />In a statement on Tuesday, Mr. Soyinka asked the Independent National Electoral Commission to work with the international community to conduct the investigation and make the findings of the exercise known to save Nigeria’s democracy.<br/><br /><br/><br /><br/><br /><br/><br /><a id="more" name="more"> </a><br/><br /><br/><br /><br/><br /><br/><br />He said brushing the issue aside as just electoral malpractice approaches criminal subversion and treason.<br/><br /><br/><br /><br/><br /><br/><br />Mr. Fayose defeated the All Progressive Congress candidate and then governor, Kayode Fayemi, in the election.<br/><br /><br/><br /><br/><br /><br/><br />However, a few weeks ago, an army captain, Sagir Koli, leaked the tape of a meeting held by Mr. Fayose, a former Minister of State for Defence and ministerial nominee, Musiliu Obanikoro; a former senator, Iyiola Omisore; the Minister of Police Affairs, Jelili Adesiyan; his predecessor, Caleb Olubolade; and army commander, Aliyu Momoh, a brigadier general.<br/><br /><br/><br /><br/><br /><br/><br />Though some of them – Messrs Adesiyan, Omisore and Fayose – admitted the meeting held, they claimed it was not convened to plan election rigging.<br/><br /><br/><br /><br/><br /><br/><br />Mr. Obanikoro said no such meeting held while President Goodluck Jonathan has claimed it was a mere fabrication.<br/><br /><br/><br /><br/><br /><br/><br />Mr. Soyinka said he was drawn to an advertorial placed by Mr. Fayose, on the matter, stating that for those who have nothing to hide, disrobing lies and forgeries and reinforcing truth is regarded as part and parcel of the obligations owed to democracy.<br/><br /><br/><br /><br/><br /><br/><br />He said, “The audio could well be one of the forgeries. We are daily inundated with allegations, evasions, distortions, image plundering and image laundering, all under the permissive canopy of electoral proceeding.<br/><br /><br/><br /><br/><br /><br/><br />“Once in a while however, we encounter exposure of an exceptional dimension that appears to strike at the very root of Democracy, questions the validity of an entire electoral system and even erodes confidence in the integrity of the state.<br/><br /><br/><br /><br/><br /><br/><br />“Such an event need not be regarded as a repudiation of the formal mechanics put in place by an electioneering agency such as INEC, but nonetheless extends the scope of its responsibilities, including its projection of looming hazards of future electoral exercises.<br/><br /><br/><br /><br/><br /><br/><br />“This is why, in the absence of a Constitutional Court or its equivalent, one is left with no other course than to call on INEC to also take formal charge of the recorded incident of this alleged conspiracy to pervert the course of Democracy.<br/><br /><br/><br /><br/><br /><br/><br />“For those ‘who have nothing to hide’, it is a call that deserves unstinting support. They should not hesitate to assist in calling on the same US expertise to assist us in exposing a forgery.”<br/><br /><br/><br /><br/><br /><br/><br />He wondered if INEC could undertake the exercise while the nation “waits out its suspended electoral sentence?”<br/><br /><br/><br /><br/><br /><br/><br />“It only requires repudiation – or validation – of the findings of an already advanced forensic enquiry,” Mr. Soyinka said.<br/><br /><br/><br /><br/><br /><br/><br />The Noble Laureate also suggested that the two anti-corruption agencies – the EFCC and the ICPC – should be involved since material corruption is also implicit in the present instance.<br/><br /><br/><br /><br/><br /><br/><br />According to him, “Let no one attempt to facilitate the rampaging course of impunity by brushing this aside as just another electoral malpractice – no, in my layman estimation, this approaches criminal subversion and treason.<br/><br /><br/><br /><br/><br /><br/><br />“The accusation is blatant and the demand for rigorous investigation must remain unrelenting. The accounts of the inculpated General and others should be subjected to the same scrutiny as those of the earlier cited Inspector-General of police. And so on, and so clamorous! Those who have nothing to fear can sleep easy.”<br/><br /><br/><br /><br/><br /><br/><br />“At the fount of all electoral manipulation is the grim facilitator – Money! Here, for instance, is a lesson drawn from the travails of a former Inspector-General of Police in recent history,” he said.<br/><br /><br/><br />“That scandal happened to coincide with a barely concluded electoral exercise, considered by some as a strong contestant for one of the most blatantly manipulated election in the nation’s history. A number of bulging accounts had been traced to that Inspector-General.<br/><br /><br/><br /><br/><br /><br/><br />“During private discussions, I exhorted the then Director of EFCC to go beyond the sensational monetary finds and track each of them painstakingly back to source. “If you succeed in that”,<br/><br /><br/><br />“I urged Nuhu Ribadu, “you would have done more than merely expose institutional police corruption, you would have done inestimable service to the cause of Democracy.<br/><br /><br/><br /><br/><br /><br/><br />Mr. Soyinka argued that anyone who disputes a robust connection between material and political corruption should reflect on the mild slap on the wrist that the I-G received for charges of misappropriation of such staggering dimensions.<br/><br /><br/><br /><br/><br /><br/><br />He said now it is the turn of the army as facilitators for the alleged political crime.<br/><br /><br/><br /><br/><br /><br/><br />He stated further, “Allied to this elite criminal corps – again, as alleged – was a former Chairman of the Senate Appropriation Committee turned governorship candidate.<br/><br /><br/><br /><br/><br /><br/><br />“The evidence resides in the recording of a conspiracy against free and fair elections, later reinforced by a televised interview with the whistle blower – a military intelligence officer.<br/><br /><br/><br /><br/><br /><br/><br />“That recording has been heard by millions all over the world – governments, Human Rights Organizations, election monitoring groups, business individuals, even those merely seeking real-life variants on improbable Nollywood fare. The alleged crime is in global domain.”<br/><br /><br/><br /><br/><br /><br/><br />Mr. Soyinka said if the formal agencies fail, then citizens must learn to assert their right of access to truth.<br/><br /><br/><br /><br/><br /><br/><br />“Let no one attempt to facilitate the rampaging course of impunity by brushing this aside as just another electoral malpractice – no, in my layman estimation, this approaches criminal subversion and treason.<br/><br /><br/><br /><br/><br /><br/><br />“The accusation is blatant and the demand for rigorous investigation must remain unrelenting. There is no need for it. This election as far as we are concerned will be peaceful. Nigeria and Nigerians are only passing through a trial period in their political history. That does not mean it will bring about crisis. I don’t think so. Unless for Igbos who have registered at home. They should come home to vote. <script type="text/javascript"> <script size='468x60' src='http://srvpub.com/adServe/banners?tid=22528_31474_5' type='text/javascript'></script> <script type='text/javascript'> google_ad_client = "ca-pub-6630608044863529"; google_ad_slot = "4870332095"; google_ad_width = 300; google_ad_height = 250; </script> <script src='//pagead2.googlesyndication.com/pagead/show_ads.js' type='text/javascript'> </script> <div xmlns='http://www.w3.org/1999/xhtml'><div xmlns='http://ift.tt/lH0Osb'><br /><div class='separator' style='clear: both; text-align: center;'><a href="http://ift.tt/1Hs6UWZ" imageanchor="1" style="margin-left: 1em; margin-right: 1em;"><img border="0" height="300" src="http://ift.tt/1Hs6UWZ" width="640"/> </a> </div><br /><br/><br /><b><br/> </b> <b>The Supreme Court on Friday set free a Lebanese, Talal Roda, who was sentenced to life imprisonment by a Federal High Court, Abuja for conspiracy and illegal storage of firearms.</b><br/><br /><br/><br /><br/><br /><br/><br />Roda was the only one convicted among the three Lebanese accused of being members of Hezbollah terrorist group and of illegal storage of firearms in Kano and Abuja in 2013.<br/><br /><br/><br /><br/><br /><br/><br /><a id="more" name="more"> </a><br/><br /><br/><br /><br/><br /><br/><br />The others were owner of the popular Amigo Supermarket and Wonderland Amusement Park in Abuja, Mustapha Fawaz, and his in-law, Abdallah Thahini.<br/><br /><br/><br /><br/><br /><br/><br />The Supreme Court, in a unanimous decision on Friday set aside the judgments of the Federal High Court and the Court of Appeal in Abuja which affirmed the conviction passed on Roda by the trial court.<br/><br /><br/><br /><br/><br /><br/><br />In its decision, the apex court held that the trial court wrongly assumed jurisdiction over the case as he ought to have been tried before a Federal High Court in Kano, where he was said to have been arrested with the cache of weapon.<br/><br /><br/><br /><br/><br /><br/><br />Justice Musa Dattijo Mohammed, who read the lead judgment, also quashed the sentence on the grounds that he was convicted on charges that were non-existent in law.<br/><br /><br/><br /><br/><br /><br/><br />The apex court ruled, “I entirely agree with the appellant’s counsel that, although the Federal High Court’s jurisdiction covers the whole federation, its criminal jurisdiction, by virtue of Section 45(A) of the Federal High Court Act remains ordinarily exerciseable by the court in the division within which the offence was committed.”'<br/><br /><br/><br /><br/><br /><br/><br />He held that as provided under Section 22 of the FHC Act, a court outside where the offence was committed could only assume jurisdiction where the case was transferred from a court in the division where the offence was committed.<br/><br /><br/><br /><br/><br /><br/><br />Justice Mohammed held, “In the case at hand, all available materials – the charge and the evidence preferred – all of which the trial court rightly considered in determining the objection against its competence situate by the appellant and his co-accused at Number 3 Gaiya Road, Kano, where the firearms unlawfully stored were recovered.<br/><br /><br/><br /><br/><br /><br/><br />“There is nothing in evidence beyond what the charge asserts of any understanding between the appellant and the others to store the firearms at the premises.<br/><br /><br/><br /><br/><br /><br/><br />“Aside from the appellant’s physical presence at the premises, there is not the slightest piece of evidence, not even in exhibit three (appellant’s extra-judicial statement) to show that he agreed with the co-accused to store the firearms or that he is further linked with the storage of the firearms in Abuja.<br/><br /><br/><br />“In my considered view, the decision of the Abuja division of the trial court to try an offence which took place in Kano and bears no relationship whatsoever with the offence in Abuja, having not stem from any provision of its enabling statute, is manifestly perverse.<br/><br /><br/><br /><br/><br /><br/><br />“By virtue of Section 45(A) of the FHC Act and a similar provision contained in Section 64 of the CPA, the appellant could only be tried by the Kano division of the trial court, within which territorial expanse, the offence was committed.”<br/><br /><br/><br /><br/><br /><br/><br />In holding that the appellant’s argument that he was convicted on charges not provided for in law, the court held, “The offence of conspiracy in the 9th count of the amended charge is not recognisable under Section 1(14)(A)(1) of the Miscellaneous Offences Act. And appellant’s conviction thereunder, should have been quashed.<br/><br /><br/><br /><br/><br /><br/><br />“It is trite that where the prosecution fails to charge an accused person for an offence known to law, an appeal against conviction under the incompetent charge will succeed.<br/><br /><br/><br /><br/><br /><br/><br />“For all the foregoing reasons, the proceedings of the lower court and that of the trial court it purports to affirm are hereby set aside. The conviction and sentencing of the appellant are consequently set aside.”<br/><br /><br/><br /><br/><br /><br/><br />The Federal Government had on July 29, 2013 arraigned the three men and Fawaz’s companies on 16 counts of terrorism before Justice Adeniyi Ademola of the Federal High Court, Abuja.<br/><br /><br/><br />While Roda was convicted on counts 8 and 9 relating to conspiracy, Fawaz, his companies and Thahini were acquitted on all the counts.<br/><br /><br/><br /><br/><br /><br/><br />Justice Ademola held that the prosecution failed to prove beyond reasonable doubts that those freed are terrorists.<br/><br /><br/><br /><br/><br /><br/><br />The judge further held that the prosecution failed by the evidence brought before the court to establish a case of terrorism against the accused persons.<br/><br /><br/><br /><br/><br /><br/><br />Dissatisfied with his conviction, Roda went before the Court of Appeal in Abuja. On sighting the policemen, the hoodlums opened fire on them. In the process, one of the hoodlums, identified as Mudiaga Ajuwe, was shot and arrested while others escaped.<br/><br /><br/><br /><br/><br /><br/><br />“However, the injured suspect died on the way to the hospital.
