text-align: center;'><a href="http://ift.tt/1yWaUZt" imageanchor="1" style="margin-left: 1em; margin-right: 1em;"><img border="0" height="316" src="http://ift.tt/1yWaUZt" width="640"/> </a> </div><br /><br/><br /><br/><br /><br/><br /><br/><br /><br/><br />‎The alleged mastermind of the April 14 bomb blast that killed over 75 persons and wounded 100 others at a crowded motor park in Nyanya Abuja, Aminu Sadiq Ogwuche, Thursday, prayed the Federal High Court in Abuja to compel the Federal Government to pay him the sum of N100million as damages,<br/><br /><br/><br /><br/><br /><br/><br />Ogwuche insisted that his continued detention in the custody of the Department of State Security, DSS, amounted to ‎a gross abuse of his fundamental human rights as enshrined in the 1999 Constitution.<br/><br /><br/><br /><br/><br /><br/><br /><a id="more" name="more"> </a><br/><br /><br/><br /><br/><br /><br/><br />He contended that ‎the Federal Government, having breached his constitutional rights, ought to be compelled by the court to pay damages to him.<br/><br /><br/><br /><br/><br /><br/><br />Besides, he prayed the court to order his immediate release from detention pending whenever the government is ready to conduct his trial.<br/><br /><br/><br /><br/><br /><br/><br />Ogwuche made the application through his lawyer Mr. Ahmed Raji, SAN.<br/><br /><br/><br /><br/><br /><br/><br />He relied on Order 2, Rule (1),(2),(3) of the Fundamental Enforcement Procedure Rule and Sections 34,35,36,37 and 42 of the 1999 Constitution to seek for an enforcement of his fundamental human right.<br/><br /><br/><br /><br/><br /><br/><br />Though he initially cited the DSS and the Attorney General of the Federation, AGF as respondents in the suit, he however applied for the court to strike out the name of the AGF, an application that was accordingly granted.<br/><br /><br/><br />‎Alleging that he was illegally arrested, Ogwuche, through his lawyer Raji‎, SAN, argued that it was based on the request of the Federal Government that the Interpol placed a red alert on him consequent upon which he was apprehended in Sudan and extradited to Nigeria.<br/><br /><br/><br />Raji further drew the attention of the court to the fact that the charge upon which Ogwuche was arrested and detained had been struck out for lack of diligent prosecution.<br/><br /><br/><br />He added that the charge was the foundation of the extradition order which led to the arrest of the applicant.<br/><br /><br/><br />Raji insisted that FG ought to have concluded its investigations before requesting for the extradition o‎rder.<br/><br /><br/><br />‎He argued that it was illegal for the DSS to still retain the accused person in its custody without arranging him over the commission of any act of criminality.<br/><br /><br/><br />‎Beside arguing that ‎the ex parte order gotten by the DSS to detain the applicant for 90 days was a miscarriage of justice, Raji, stressed that section 27 of the Terrorism Prevention Act could not override the provisions Section 35 of the Constitution which he said preserved the right to liberty of every citizen.<br/><br /><br/><br /><br/><br /><br/><br />He therefore prayed the court to compel the DSS to release Ogwuche conditionally or unconditionally, admit him to administrative bail or arraign him within 48 hours.<br/><br /><br/><br /><br/><br /><br/><br />Meantime, trial Justice Ademola Adeniyi has fixed today to hear the response of counsel to the DSS Mr. Clifford Osagie to the application.<br/><br /><br/><br /><br/><br /><br/><br />‎It will be recalled that the court earlier struck out a three-count charge that was filed against Ogwuche by the Police for want of diligent prosecution.<br/><br /><br/><br /><br/><br /><br/><br />The case was terminated following bickering between the Police and the DSS over which of them should conduct the trial.<br/><br /><br/><br /><br/><br /><br/><br />Though the DSS insisted that the initial charge by the police was only meant to expedite the process that led to the successful extradition of the accused to Nigeria, however, since then, it is yet to file any charge against him.<br/><br /><br/><br /><br/><br /><br/><br />‎Ogwuche was in the charge that was struck out, alleged to have conspired with others (at large), to commit an act of terrorism by detonating improvised explosive devices at Nyanya Motor Park, which resulted in the death of 75 persons and injuring over a hundred other persons.<br/><br /><br/><br /><br/><br /><br/><br />Count two of the charge reads, “That you, Aminu Sadiq Ogwuche, Male, and others now at large, on the 14th of April, 2014 at Nyanya, FCT, Abuja, within the jurisdiction of this honourable court, did facilitate the activities of persons engaged in an act of terrorism; It is the kind of fable that can only come out of the mouth of someone who is delusional; one whose intoxication with power is not in doubt”, Tinubu added.</p><br /><br/><br /><p>In a statement signed by Dare last night, the ex-Lagos governor alleged that “the defence budget to fight Boko Haram and Terrorism has become a conduit pipe for the ruling party, PDP, just as the likes of Obanikoro continue to use Boko Haram as a tool of blackmail against the opposition. This time, just like it failed in the past, it will not stick. It will not stand”.</p><br /><br/><br /><p>Accusing the PDP and the minister of aiding and abetting Boko Haram, Tinubu said, “It is the PDP led government in which Obanikoro is an active and pliable agent that is perpetrating the insurgency for pecuniary benefits. This government has no shame. It lacks the moral authority to point fingers at individuals or the opposition. The country is literarily on tenterhooks and all the PDP can do is lie to Nigerians in order to cover up its failures.</p><br /><br/><br /><p>“The PDP is preparing the grounds for its next round of hounding opposition leaders, militarising our cities and violating the democratic rights of Nigerians to move freely. Chris Olukolade, at the briefing of the Joint National Information Centre, Abuja, said the allegations against troops are false and baseless.</p><br /><br/><br /><p>He said the Nigerian military and other security agencies are guided by global rules of engagement.</p><br /><br/><br /><p>He, however, did not rule out the investigation of human rights abuses by the military whenever such is believed to have occurred.</p><br /><br/><br /><p>“The position of the Nigerian armed forces and security agencies is guided by rules of engagement which we will continue to abide by. Accusations of human rights abuse will be investigated whenever it is believed to have occurred”, Mr. Olukolade said.</p><br /><br/><br /><p>He said such allegations against the Nigerian military has become a pattern for most organizations, who doubt the ability of the military to maintain its operations. He also insisted that the military is conducting all its operations in the ‘most professional manner’.</p><br /><br/><br /><p>Maj-Gen. Olukolade disclosed that some troops lost their lost their lives in the bomb explosion that occurred at a Maiduguri market on Tuesday.</p><br /><br/><br /><p>He also said that the Nigerian military and other security agencies will continue to defend the nation even at the point of death.</p><br /><br/><br /><p>The defence spokesman, however, denied reports that residents at the scene of the Maiduguri blast attacked the military and fire fighters.</p><br /><br/><br /><p>“We just know that our men did their job on that spot. Terror is evil; nowhere in history has evil endured forever.</p><br /><br/><br /><p>“The menace of Boko Haram will surely come to an end. I believe that because of your prayers, your courage, hardwork, faith and sacrifice, we will ultimately prevail over the terrorists and all other evil forces.”</p><br /><br/><br /><p>The president commended the Armed Forces for the supreme price they had paid in confronting insecurity and urged Nigerians to always appreciate them rather than castigate them.</p><br /><br/><br /><p>“We must show confidence in their ability. So, to assume that western education is a sin is indeed a thought of the misguided mind, it’s not part of Islamic thinking. And this is one of the points that we are trying to prove here like I said earlier, through this education that Muslims are indeed, the custodians of knowledge.”<br/><br /><br/><br /><br/><br /><br/><br />According to him, the exhibition is to correct the erroneous impression that Islam is vehemently opposed to education and knowledge.<br/><br /><br/><br /><br/><br /><br/><br />“So we are organizing this exhibition to showcase the beauty of Islam. We are having more than 25,000 collections of Islamic titles here and the works that Muslim intellectuals have done. When you see this, you will agree with me that indeed, Islam is a religion of intellects, a religion of knowledge and that is what we are trying to prove to the world.<br/><br /><br/><br /><br/><br /><br/><br />“Islam does not distinguish between education, there is no difference between Islamic and western education. In the past, we have among our ancestors, Muslim intellectuals who were basically mathematicians like Aljeberi, like Alberuni, these were Muslims and they were mathematicians,” Abumazeedah added.<br/><br /><br/><br /><br/><br /><br/><br />He said, “Everybody knows that Islam is a religion of peace. In fact, there is no religion in the world that has the interpretation as peace. If you adhere sincerely to Islam, you will have peace in your mind, you will have peace if a country adheres to Islam, peace will prevail, so Islam is a religion of peace.”<br/><br /><br/><br /><br/><br /><br/><br />Asked about Islamic faithful who believe that western education is a taboo and sin, the ABU don blamed the belief on western propaganda.<br/><br /><br/><br /><br/><br /><br/><br />“I think that propaganda has been foiled by westerners themselves and I beg to request for anyone to provide authority that any true Muslim scholar has said that there is a dichotomy between western education and Islamic education. I think the problem is that there is a lot of misguidance, a lot of misunderstandings and a lot of inter-mixing, philosophy, culture, de-culturalisation and of course sometimes, ethnicity. Even as we are planning, we do not make strategies and reveal them on the pages of newspapers and electronic media.<br/><br /><br/><br /><br/><br /><br/><br />“When the new chief of defence staff was appointed, he said insurgency in the country will end in April 2014.<br/><br /><br/><br /><br/><br /><br/><br />“Even if he was planning towards it, he shouldn’t have made such a statement. Since then, the insurgency has continued to escalate.<br/><br /><br/><br /><br/><br /><br/><br />“As foreign countries are coming to help with the Chibok kidnapping, it should have been done in a way that it wouldn’t alert those insurgents,” he said.<br/><br /><br/><br /><br/><br /><br/><br />Ajakaye said that telling the public the number of insurgents captured or killed was also not proper.<br/><br /><br/><br /><br/><br /><br/><br />He said also that there was the need for the government to ensure that its entire security agencies were motivated enough to tackle insurgency.
